New York State Disability (NYSDBL)
New York State enacted the disability benefits law in 1949. This law states that if you are an employer and employ one or more employees for at least 30 work days in any calendar year, you are then required to obtain coverage with few exceptions. The disability benefit law payout is 50% of the average weekly wage, with a maximum of $170, and a 26-week maximum benefit / 52 week with a 7-Day wait for accident and sickness.
Unlike worker’s comp, New York state disability insurance covers off-the-job-disability as required by New York state law for all payroll business employees. A payroll deduction is made from each employee’s salary to cover the cost of the premiums. New York is one of approximately 8 states that now require disability insurance for employees. For more than two decades, Cafaro insurance agency has offered this required coverage for companies throughout our service area, which includes Farmingdale, Hauppauge, Melville, Smithtown, Huntington and many other New York communities.
Paid Family Leave (PFL) is now required with NYS Disability
As of January 1st 2018, nearly all private employers in New York state must now secure Paid Family Leave coverage for their employees. This coverage is funded by employee payroll deductions and provides wage replacement and job protection to employees who need time away from their jobs for reasons that include:
- Bonding with a newly-born, adopted, or foster child
- Caring for a family member with a serious health condition
- Assisting loved ones when a family member is deployed abroad on active military duty.
Employees with a regular work schedule of 20 or more hours per week are eligible after 26 weeks of employment while employees with a regular work schedule of less than 20 hours per week are eligible after 175 days worked. In some limited circumstances, employees whose regular work schedules are temporary or seasonal may opt out of Paid Family Leave.
Employers may collect the cost of Paid Family Leave through payroll deduction. The maximum employee contribution in 2019 shall be 0.153% of the employees weekly wage, up to the annualized New York State Average Weekly Wage.

Please note that employers must continue employee’s health insurance while they are on paid family leave. Employers may require that employees continue to pay their health insurance premium contributions. It is the responsibility of employers to ensure that their employees are aware of the Paid Family Leave program and that their organizational policies comply with the law.
